Terms and Conditions of the "EARN UP TO £5,000 DEPOSIT BONUS" for City Index UK

  1. You agree that by participating in the "Earn up to £5,000 deposit Bonus offer" (the "Promotion") that you will be bound by these Promotion Terms and Conditions (these "Promotion Terms") as well as the general terms and conditions that apply to your Account ("Our Terms"). Terms and expressions used in these Promotion Terms shall have the same meaning as in Our Terms unless specified otherwise.
  2. The Promotion is offered by City Index Limited, of Park House, 16 Finsbury Circus, London EC2M 7EB ("City Index", "we" or "us").
  3. Subject to paragraph 14 below, to be eligible to take part in the Promotion you must:

    (a) be over eighteen (18) years of age and have successfully opened or already have open a City Index spread betting or CFD account ("Account");

    (b) have not been introduced to City Index through any introducing broker arrangement or hold an Account with City Index under a different trading name or partnership arrangement, for example Finspreads

    (c) not be the subject of any dispute, suspension or default;

    (d) have passed the "appropriateness" requirements as determined by City Index;

    (e) be resident in the United Kingdom of Great Britain and Northern Ireland; and

    (f) have registered to participate in the Promotion;(anyone who meets this criteria shall be deemed a "Qualifying Applicant"

  4. For the purposes of these Promotion Terms, "Bonus" shall mean the amount calculated by City Index in accordance with the table set out below, subject always to a maximum of £5,000 per Qualifying Applicant.  The Bonus calculation shall be based on the first deposit made into the Account during the Promotion Period (excluding any margin funding requirements).

  5. The Promotion is strictly limited to one (1) Bonus payment per Qualifying Applicant.
  6. The "Promotion Period" shall run from 6pm London time on 22nd June 2009 until 6.00pm London time on 13th July 2009.
  7. In order to participate in the Promotion and receive the Bonus as calculated under paragraph 4 above, Qualifying Applicants must:

    (a) during the Promotion Period, deposit a minimum of £1,000 into their Account (excluding any margin funding requirements); and

    (b) execute the corresponding minimum number of "Qualifying Trades", which for the purposes of the Promotion Terms shall mean any CFD trade or spread betting trade which is entered into before 31 August 2009 in the Applicable Markets (as detailed below) and that meets the qualifying criteria (also detailed below), excluding at all times any trade which is not executed at normal "market risk" and which is entered into with the intent and/or which has the effect of making the trade "risk-free" or less risky than normal "market risk" by any means including but not limited to strategies using Other Accounts (as defined below), rolling trades, "opposing trades", "arbitrage trades", "bet-matching trades" or such other similar hedging strategies.

    (collectively paragraphs 7(a) and 7(b) means the "Bonus Requirements")

  8. For the purposes of these Promotion Terms, any "Other Account" shall mean any other CFD trading or any other financial spread betting whatsoever, whether in the name of the Qualifying Applicant or not, and whether or not such Account is with City Index or any third party.
  9. Notwithstanding paragraphs 7(b) and 8 above, City Index shall have the sole discretion to determine whether or not a trade is a Qualifying Trade.
  10. Subject always to the Bonus Requirements having been met, City Index will endeavour to ensure that the Bonus will be paid into the Qualifying Applicant’s Account within five (5) Working Days of all Bonus Requirements being met, however City Index shall not be liable for any delays.
  11. The Bonus can only be used for placing bets/trades but cannot be withdrawn from your account as cash.  Any profit from your trades may be withdrawn at anytime. If any amounts are due any owning to us, we reserve the right to deduct such amounts from any deposit into your account and such amount will not apply for the purposes of this Promotion.
  12. RISK WARNING:

    (a) It is important that Qualifying Applicants are aware that their risks are not limited to the deposit and that by making a Qualifying Trade it is possible to lose more than the deposit.  In some circumstances Losses may be considerably more than any initial or minimum deposit;

    (b) Qualifying Applicants should carefully read these Promotion Terms, Our Terms and the risk warnings;

    (c) In the event that Qualifying Applicants incur losses greater than the Bonus, the Bonus may be used to offset your debt to us; Under no circumstances will City Index be liable for any losses that Qualifying Applicant’s may incur as a result of trading on their Account(s) under this Promotion.

  13. In the event that a non-Qualifying Applicant takes part in the Promotion, and/or we deposit a Bonus amount in error, we reserve, without prejudice to any of our other rights under these Promotion Terms or Our Terms, to seek the return of the Bonus from the Account of that person, and that person agrees to promptly transfer and deliver and cause to transferred and delivered such amount to us.
  14. Neither the employees of City Index Limited or their group, or other producers or suppliers associated with this Promotion, their advertising, printing and publicity agencies, and their immediate family members (i.e. any person residing in the household of the aforementioned people) will be eligible to participate in the Promotion.
  15. We reserve the right at our sole discretion to disqualify any individual that tampers or attempts to tamper with the operation of the Promotion, or breaches the Promotion Terms or Our Terms.
  16. We may use the information that you provide during the Promotion registration process to provide you with information about our products and services. You must inform us if you do not wish to receive such information by emailing [email protected]
  17. We reserve the right to alter, amend or terminate this Promotion, or any aspect of it, at any time and without prior notice.  We may make changes to these Promotion Terms and will notify you of these changes by posting the modified terms on the City Index website.  We recommend you revisit these Promotion Terms regularly, and by your continued use of the City Index websites and services you accept any such modified terms.
  18. Any dispute or situation not covered by these Promotion Terms will be resolved by our management in a manner it deems to be the fairest to all concerned, and that decision shall be final and/or binding on all entrants.  No correspondence will be entered into.
  19. If the Promotion can not be executed as planned, including any problems or technical malfunction beyond our control, we shall incur no liability.
  20. This Promotion will be governed by the laws of England and Wales.
  21. If any term of these Conditions is found to be illegal, invalid or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from these Conditions and shall in no way affect the legality, validity or enforceability of the remaining terms.
  22. If these Promotion Terms are translated into a language other than English, then the English version of the Rules shall prevail where there is an inconsistency.
